General Terms of Use.

1. Preamble


These General Terms of Use govern your use of the SINGULARITY application. By using the application, you agree to these conditions unreservedly. If you do not accept them, you cannot use the application.


2. Editor of the Application


The SINGULARITY application is published by VAONIS, a French company located at 225 rue Didier Daurat, 34170 Castelnau-le-Lez, France. It has a share capital of €17,133.80 and is registered with the Trade and Companies Register of Montpellier under number SIRET 823 710 447.


3. Description of the Application


The SINGULARITY application enables users to control VAONIS telescopes, including models such as STELLINA, VESPERA, and HYPERIA. It offers features like observing space, taking photographs, saving observation points, consulting weather forecasts, and storing images on your device or VAONIS Cloud. A solar filter accessory is required for sun observation. Users must create a member account to access these features.


4. Technical Requirements


The application is available on the Apple Store and Google Play for iOS (version 14 and above) and Android (version 8-9 and above). A Wi-Fi internet connection is necessary. Without a VAONIS Telescope, functionality is limited to creating an account and viewing certain content.


5. Update


The terms may be updated periodically, with notifications sent to the email linked to your account. The latest version is always available on the VAONIS website.


6. Free of Charge Application


The application is free to use, though a VAONIS Telescope is required for full functionality. Some features, like solar observation, require additional accessories, such as a solar filter sold by VAONIS.


7. Member Account


7.1 Creation

Users must provide their full name, email, and agree to terms to create an account. Account sharing is limited to personal household use.


7.2 Credential Management

Users are responsible for maintaining account confidentiality. Password recovery options are available.


7.3 Deletion

Deleting the app does not delete the account. Users can request account deletion via the application or by emailing dpo@vaonis.com.


8. Access Requests


8.1 Geolocation Data

Required for telescope setup and accurate observation. Users can manually input data or enable GPS.


8.2 Profile Customization

Users may input interests for personalized content.


8.3 Telescope Connection

A tutorial guides users in connecting the application to their telescope.


8.4 Calendar Access

Sky observation events can be recorded in the user’s device calendar.


8.5 Photo Gallery Access

The application requires access to the device’s gallery for saving telescope photographs.


8.6 Sharing Features

Users can share telescope photos via third-party services, with VAONIS disclaiming responsibility for third-party use.


9. Responsibility


9.1 Application Interruption

VAONIS is not liable for temporary service interruptions.


9.2 Cloud Storage

VAONIS advises users to back up Cloud-stored content elsewhere.


9.3 Third-Party Services

VAONIS is not responsible for third-party services accessed via the app.


9.4 Consequential Damages

VAONIS disclaims liability for indirect damages from application use.


9.5 Warranties

Adherence to VAONIS instructions is essential for maintaining product warranties. Failure to comply may void legal guarantees.


10. Intellectual Property Rights


10.1 VAONIS Property

The application and its content are protected by intellectual property laws. Usage is limited to personal and non-commercial purposes unless expressly authorized by VAONIS.


10.2 User Content

Photographs created using the telescopes remain the user’s property. Users grant VAONIS a non-exclusive license for hosting and publication on the Cloud or within the app.


11. Personal Data


VAONIS processes personal data as a data controller under the EU GDPR and French data protection laws. Users must agree to the Privacy Policy to use the application.


12. Duration


These terms remain effective until users cease application usage and/or delete their accounts. Some provisions survive termination to resolve disputes.

14. Governing Law and Dispute
